In other number news, BMI and Pandorra are in court over artist compensation. The performance rights organization (BMI) wants 2.5% of revenue and the streaming site (Pandorra) wants to pay 1.75% as they have in the past. The 1.75% rate was an “experimental” rate that earned BMI $16.1M last year, but BMI points out that some other organization (ASCAP) got a higher rate awarded to it from another streaming service (Launchpad) and somehow that is relevant even though that court case is under appeal or something. All very confusing. Why are the courts even involved? Aren’t companies supposed to negotiate? BMI also points out that Pandora paid other rights organizations (Sony/ATV, EMI and UMPG) more in the past (2.25%) and that the rate paid to those organizations was even higher in 2014 (though nobody is allowed to say what it is). I’m going to leave this one up to the judge.

They US Copyright office is also putting out a bunch of proposals. Most seem related to putting performance rights on a more equal footing with mechanical rights. Lots of people fighting over smaller pieces of the pie and the lawyers are making hay.
