X Factor Sued By Elderly Contestant Too Exhausted to Compete

First, it was former-pal, Simon Fuller suing X Factor for producer credits, now Simon Cowell’s new singing competition show is being sued by a trio of contestants–86-year-old  Hyman Marks, his 54-year-old son, Stephen Marks, and 78-year-old wife, Helen Marks, reports The Wrap

The suit claims that Hyman and Stephen were put through such a punishing physical ordeal prior to their actual audition, that it left them too exhausted to perform competitively.

According to the suit, Hyman and Stephen made it through multiple rounds of auditions in Miami. Eventually, the “X Factor” staff noticed the novelty of the father-son contestants and decided to give them extra air time — and that’s where the trouble began.

The suit claims that the Hyman clan was made to film a segment numerous times, in which they were made to walk from a car into Miami’s Bank United Center while a camera filmed multiple takes. Between the 96-degree heat, Hyman’s age and Stephen’s asthma, the suit alleges, the regimen equaled disaster for the “X Factor” hopefuls.

“As a result of this grueling and discriminatory physical and mental exertion, the judges and the audience never got to see the real Hy Marks and Stephen Marks that day, ” the suit reads.

Simon voted no on the duo because, according to the suit, he felt that Hyman was not up to the physical rigors of the process.

The suit names Fox, Simon and X Factor as defendants and claims negligence, fraudulence of representation, and mental anguish.

In the suit, The Marks ask for another audition…or $1, 000, 000 for each of the 3 defendants, totaling $3, 000, 000.

Another audition or….1 MILLLION DOLLARS! *said in Dr. Evil voice*.  Unlike the Fuller litigation, I can’t imagine this suit is going to get very far.

Still. The show isn’t even on the air yet, and the lawsuits are rolling in! Imma gettin’ out the popcorn.
